A Power of Attorney can be either general or enduring. Lasting Powers of Attorney (‘LPA’) allow you to choose someone who you trust, to act on your behalf and make financial or welfare decisions if you are unable to do so. If you lose capacity to manage your own affairs, and you do not have an LPA (or an Enduring Power of Attorney ) in place, someone will need to obtain a Court of Protection. You can no longer make an EPA. The attorney is authorised to access the donor’s bank accounts, sell the donor’s property or make payments.

Enduring Powers of Attorney (EPA) will allow a named person to take care of your personal or financial matters if you are no longer able to make decisions for yourself.
